Governance Committee

 

Mission:

To review Condominium Association governing documents and Oregon Condominium law. Make recommendations to Board of Directors for possible modifications to governing documents. Respond to questions raised by Board members concerning implementation of document provisions and related matters.

 

Accomplishments, 2007

  • Provided Board members with document (May 10, 2007) summarizing committee review of all governing documents along with suggestions for revisions as noted.
  • Prepared revisions to House Rules documents for review/approval by 2008 Board of Directors.
  • Advised and responded to questions or issued from Board of Directors:
    • Existing unit rental provisions/suggested meeting with attorney to explore possible limitation ton total number of rental units and minimum length of a rental contract.
    • Requirements for calling special meetings of the Board.
    • Provide Board with current revision of all governing documents and relevant portions of Oregon Condominium Law (Chapter 100).
    • Provided Board summary of real estate related laws passed in the 2007 Legislative Session.
    • Prepared draft document concerning unit key access policy. Reviewed by attorney and approved with minor revisions.
    • Clarified process of placing a lien against a property and alternative measures (i.e., money judgment against the owner; small claims court if amount under $5,000).
    • Procedures to correctly (Roberts Rules of Order) draft and have processed a letter of resignation.
    • Gave opinion and recommendation concerning the possible use of Unit #105 (formerly manager’s residence).
    • Gave opinion (with lawyer agreement historically) that Board may in certain cases impose an assessment to cover major exterior work on the building without a vote of the owners (Bylaws Section 7.3).

 

Goals 2008

  • Submit to newly constituted Board of Directors for their review and approval of the Committee’s proposed changes to the House Rules document.
  • Advise and respond to questions from newly constituted Board of Directors concerning requirements and guidelines contained in Association governing documents and Statute. Respond to questions or concerns as they occur.
  • Assist in tracking progress in seeking legal avenues to limit the total number of rental units allowed and establish a minimum length of a rental agreement between owner and renter.
